1. About Glitta
Glitta ("Glitta", "we", "us", "our") operates an online marketplace platform (the "platform") that connects customers booking events ("Customers") with independent third-party service providers such as DJs, entertainers, face painters, event planners and party vendors ("Vendors").
Glitta facilitates discovery, booking, payment handling, and post-event processes.
Glitta is not a party to the contract between Customers and Vendors.
2. Acceptance of These Terms
By accessing or using the Platform, you agree to be bound by these Terms & Conditions ("Terms").
If you do not agree, you must not use the Platform.
You must be at least 18 years old to create an account or make a booking.
3. Marketplace Model
- Vendors are independent contractors and are not employees, agents, or representatives of Glitta.
- Any booking forms a direct contract between the Customer and the Vendor.
- Glitta does not provide event services and does not supervise or control Vendors.
- Vendors are solely responsible for their services, staff, equipment, and conduct.
4. Accounts & Access
4.1 Browsing
Customers may browse listings without creating an account.
4.2 Account Creation Required For:
An account is required to:
- Complete checkout
- Manage bookings
- Leave reviews
- Receive payouts (Vendors)
Users agree to provide accurate information and maintain account security.
5. Bookings & Availability
- Vendor availability is based on information supplied by Vendors, including optional third-party calendar integrations.
- Availability is not guaranteed until the Vendor confirms the booking.
5.1 Vendor Confirmation Window
- Vendors must confirm or decline a booking within 24 hours.
- If no response is received, the booking may be cancelled automatically and the customer refunded.
6. Pricing, Fees & Payments
6.1 Pricing
Prices are set solely by Vendors and may vary based on event details.
6.2 Payment Processing
Payments are processed via secure third-party providers (e.g., Stripe).
- Customers are charged at checkout.
- Funds are held by Glitta in a safeguarded account until release conditions are met.
6.3 Payment Structure
- 50% of the booking total is payable at time of booking.
- The remaining 50% is payable seven (7) days prior to the event.
- After the event, Customers have 48 hours to raise a dispute.
- If no dispute is raised, the final balance is released automatically.
6.4 Platform Fees
Glitta charges Vendors a commission or service fee, disclosed during onboarding or in the Vendor dashboard.
7. Vendor Payouts
Payouts are contingent upon:
- Successful event completion
- No unresolved disputes
- Compliance with platform policies
- Completion of post-event checks where applicable
Glitta reserves the right to delay, withhold, or offset payouts in cases of:
- Fraud or suspected fraud
- Policy breaches
- Chargebacks
- Regulatory or compliance issues
7.1 Documentation Requirements
Valid insurance certificates and trade licences must be uploaded at least 7 days prior to the event. Payments will not be released until documentation is verified.
Vendors warrant that:
- They hold all required licences and permits
- They maintain valid insurance
- They comply with all applicable laws and regulations
- They are responsible for staff conduct and safeguarding obligations
8. Cancellations & Refunds
8.1 Customer Cancellations
- Cancellation terms depend on the Vendor's stated cancellation policy shown at booking.
- Refund eligibility and timing are determined by that policy.
8.2 Vendor Cancellations
- Vendors are expected to honor confirmed bookings.
- Repeated or late cancellations may result in:
- Financial penalties
- Reduced visibility
- Account suspension or removal
8.3 Replacement Assistance
Glitta may assist in sourcing replacements but does not guarantee availability.
9. Dispute Resolution
Disputes must be submitted within 48 hours of event completion via the Platform.
Customers must provide reasonable supporting evidence where requested.
Glitta may review communications, documentation, and evidence provided by both parties.
Glitta may:
- Release funds
- Partially refund
- Withhold funds pending resolution
Glitta's decision regarding escrowed funds is final in relation to the Platform process.
Nothing prevents parties from pursuing independent legal remedies outside the Platform.
10. Chargebacks & Fraud
If a payment is reversed or disputed through a bank or card provider:
- Glitta may recover the amount from the Vendor.
- Chargeback fees may be deducted from future payouts.
- Glitta may suspend accounts pending investigation.
11. Taxes
Vendors are solely responsible for their own tax obligations, including VAT or other applicable taxes.
Glitta does not withhold taxes unless legally required.
12. Reviews & Ratings
Reviews must be honest and respectful.
Glitta may remove reviews that are abusive, misleading, or violate policy.
13. Prohibited Conduct
Users must not:
- Circumvent the Platform to transact offline
- Misrepresent services
- Upload unlawful or infringing content
- Engage in fraud
Accounts may be terminated for violations.
14. Intellectual Property
All Platform branding, content, and software remain the property of Glitta or its licensors.
15. Force Majeure
Glitta is not liable for failure or delay due to events beyond reasonable control, including but not limited to:
- Natural disasters
- Government restrictions
- Power outages
- Payment provider failures
- Public health emergencies
16. Limitation of Liability
To the maximum extent permitted by law: Glitta's total aggregate liability arising from any claim shall not exceed the total platform fees received by Glitta in relation to the relevant booking.
Glitta is not liable for:
- Vendor performance
- Event outcomes
- Indirect or consequential losses
Nothing limits liability where it cannot legally be excluded.
17. Indemnity
You agree to indemnify and hold Glitta harmless from claims arising from:
- Your use of the Platform
- Your breach of these Terms
- Your services (Vendors)
- Your event conduct (Customers)
18. Termination
Glitta may suspend or terminate accounts at its discretion for violations, risk, fraud, or reputational harm.
19. Governing Law
These Terms are governed by the laws of United Arab Emirates.
Courts of that jurisdiction shall have exclusive authority.
